HOMEOWNERS CONCERNS & COMMENTS: There were no concerns or comments presented.
CALL TO ORDER: The meeting was called to order at 4:06 P.M. Board members present were; David Lewis, Vince Travens and Noel Richetti. Carolyn Treanor, Treanor & Associates, Michael Paulson, Maintenance Supervisor and Janet Martell, Administrative Assistant were present. Also in attendance were Joe Bill and Scott Nelson.
PREVIOUS MINUTES:
Meeting Minutes April 2009: The Board reviewed the minutes of the April 6, 2009 board meeting.
David Lewis moved that the minutes be approved. Noel Richetti seconded, all ayes, no nays.
STAFF REPORTS:
- GENERAL MANAGER:
- Financial Reports:
- April 2009 Accounts Payable: The April accounts payables in the amount of $22,443.98 were submitted for the Board’s review and signature.
- April 2009 Spreadsheet Review: The budget spreadsheets were presented for the Board’s review and discussion. In summary all is in order.
Noel Richetti moved to accept the financial reports for April 2009 as submitted, David Lewis seconded, all ayes, no nays.
- FIELD MANAGER:
- Hilltop Parking Deck: Michael Paulson presented the engineering plans submitted by Building Concepts Inc, for the Hilltop Parking Deck. A discussion followed. Mr. Paulson stated that the project should be underway in approximately two weeks.
Noel Richetti left the meeting at 5:07 pm.
- Hilltop Parking Deck Litigation: According to the Findings of Fact and Conclusion of Law handed down in the Ninth Judicial District Court of the State of Nevada in and for the County of Douglas; Hilltop Duplexes Homeowner’s Association, Inc., a Nevada Non-Profit Corporation; Sherie Rich; and Maxine Yip, Plaintiffs, vs. Summit Village, Inc., a Nevada Non-Profit Corporation; Does I-XX; and Black Companies 1-20, Defendants, Case No. 07-CV-0081, Dept. No. II, the court finds that, as a matter of law, the lower parking deck on Tramway Drive is Summit Village’s responsibility.
According to the Amended Order Certifying Decision as Final Judgment dated April 16, 2009, all other issues remaining after the Court’s Order of September 19, 2008 were Dismissed Without Prejudice.
Therefore, Summit Village HOA is required to repair or replace the existing Hilltop parking deck. The estimated cost to repair the parking deck is $150,000.00. A discussion followed.
NEW BUSINESS:
- Newsletter Update: Carolyn Treanor reported that the newsletter was mailed on May 1, 2009 (see exhibit A).
- Request from 216 Ski Court, Units A & B to Consolidate Duplex Lot into One Parcel: The general manger presented a letter from Jeffrey Rahbeck, Attorney regarding Schuss Investments/APN Nos: 1319-19-710-023 and 024, requesting that Summit Village approve the consolidation of the two parcels into one parcel. A discussion followed.
It is the general consensus of the board that the request be approved. The general manager at the direction of the board will draft a response to Mr. Rahbeck informing him of the Board’s decision and explain that Summit Village HOA is a planned unit development and the dues will not be decreased and must remain and paid as two separate assessments.
OTHER: There were no items to discuss.
